Creating Successful Design Professional Agreements-Dealing With The Hot Button Issues

Learn how to avoid the pitfalls of pro-owner provisions and how to negotiate provisions that are more designer friendly.

Owners often present the design professional with an agreement that has been drafted to protect the owner’s interests rather than a standard AIA or EJCDC owner-design professional agreement that is generally more favorable to the designer. Mr. Rubin and Ms. Biser will instruct design professionals how to avoid the pitfalls of these pro-owner provisions and how to negotiate provisions that are more designer friendly. Particularly, they will discuss provisions dealing with indemnification, ownership of the design, waiver of consequential damages, limitation of liability, dispute resolution, insurance, architect’s certifications, among others. Mr. Rubin and Ms. Biser will also discuss and provide specific examples of pro-designer provisions.
